The Build America, Buy America Act and the Buy American Act*
The Build America, Buy America Act (BABAA) and the Buy American Act (BAA) are laws that encourage the use of American-made goods and materials, but they apply in different situations and have different requirements. The BABAA applies to infrastructure
projects that receive federal financial assistance, while the BAA applies to federal government purchases for its own use. This webpage offers information for navigating these laws.1
BABAA applies to public works projects anywhere in the US, including state and local projects, that use federal funds. BABAA applies to three categories of products: (1) iron or steel, (2) manufactured products, and (3) construction materials. ETC’s products
are either “iron or steel products” or “manufactured products.”2
An iron or steel product is BABAA compliant if all manufacturing processes for the iron or steel, from the initial melting stage through the application of coatings, occurs in the United States. A manufactured product is BABAA compliant if (1) the product
is manufactured in the US and (2) more than 55%3 of the cost of the product’s components was produced or manufactured4 in the US. For the first element, ETC is proud that the majority of our products are manufactured in the US—with
production facilities in Middleton and Mazomanie, Wisconsin as well as in Austin, Texas. For the second element, please see the table below.
The BAA created a national preference for the government to buy “domestic end products”5 for public construction projects, unless a waiver has been granted. As of 2024, the current domestic content threshold is 65 percent. By 2029, the domestic
threshold will be 75 percent.
For the most part, ETC products are manufactured in the US and most likely qualify as “domestic end products.” However, some ETC products do not qualify as “domestic end products”, including the OneTrack products; Mosaic family of products;
Pathway branded products; Sohrana line voltage sensors; and the High End Systems branded moving lights.
The information below may be able to help you determine whether ETC products meet your project requirements. The “domestic end product” requirements for US government agency purchases of goods generally apply to contracts that are (i) above the micro-purchase
threshold of $10,000 USD, and (ii) are above the applicable trade agreement threshold.6
- Is there an applicable Trade Agreement? If there is an applicable trade agreement, many ETC products, except for those listed above, can be considered a domestic US product for the purpose of US procurement requirements.
Trade agreements
may not be applicable if the project involves state or municipal purchases. For those projects, you need to confirm the applicability of any trade agreements with the general contractor prior to submitting your purchase order to ETC.
- What Government Agency is Providing the Funding? Certain government agencies have their own domestic product requirements: Federal Aviation Administration, Federal Highway Administration, Department of Defense, Federal Transit Administration. Please
review whether your contract receives funds administered by one of these agencies as domestic product requirements may vary.
